Okay, so SGI requested me draw up a diagram showing what happened cause the elderly man's memory didn't prevail to help them figure the situation out. After drawing this out and advice from other's im realizing i don't think im 100% at fault. Here is the picture be the judge of it and let me know what you think and ways i could simplify the picture to make it more clear to the adjuster.

I was the one making the left hand turn into the parking lot, whereas he was leaving from his parking spot where he was at a complete stop.

You cannot drive in the parking lane and therefore he is at fault, I believe but I am not sure they will consider him 100% at fault or not.

You seem to have bad luck with new vehicles:
Jeep --> Rear Ended First Week
Civic --> Accident First Week

but like .. thats a tough thing to say, since if hes parked there how is he supposed to leave.move forward and well you didnt see him doing that so maybe its your fault, but most likely i could see it been his fault.

I think he might be at fault too, pulling out in front of you in a parking lane, but thats just my guess.

I'm pretty confident that it isen't 100% my fault from futher speculation.
I will be submitting this to SGI on Wednesday so they will make the final decision.

I'd say 50/50.
A) He was parked there and how else was he supposed to leave + you turned across traffic and hit him
B) He was parked right infront of the entrance too a parking lot and should have waited till no one was coming.

He could have left by signaling left and pulling out left. But would that have made a difference?

Well you see i made my intial scan on oncoming traffic to make sure it was safe to proceed with my left turn, that includes the parking lane nothing was moving otherwise i would have not went. After starting my turn i smeered my vision across to the entrance of the parking lot to make sure it was free of traffic and clear to enter. Thats when in my periferal vision i noticed the 05 Impala crossing my path giving me no time to react.

i still say its most likely going to be your fault, or maybe 50/50. but how else is the guy supposed to leave and doesnt he have the right-a-way since your crossing traffic...

But, he was not in the driving lane he was driving through the intersection in the parking lane which is illegal. The guy couldn't even read his information to take it down so my guess is he can't see worth a shit and shouldn't be driving anyways. If you can't read to take down information there is no way in hell you should be allowed on the road.

Hmm I'm not even sure what the consequences of a 50/50 accident are since every accident I have been in have been 100% the other guys fault. I would assume that you will pay for your own deductible and will get points off your license ... maybe even another safe driving course lol!

They couldn't give me a striaght answer of how long it would take to come up with who's at fault.

Gr, still no fricken letter from SGI. I tried giving my adjusster a call but no dice on that either.
Does anyone have any past experience with this how long does it take for a verdict to be decided?!
